Primark won't exchange my shoes is that legal?

my friend bought me some shoes in primark, they were too big, they still have the label on, i dont have a receipt so i took them back thinking i could get a smallar size but they dont do exchanges!?i know primark is super cheap but its a matter of principle!

they do exchanges. they should be unworn, still with the label on. But its up to the managers discretion whether to exchange them for you as you don%26#039;t have the receipt.
Reply:You need a reciept for proof. That is everywhere. You should ask to see their policy on exchanges. Yes it is legal for them do to so.

Reply:how come i took a skirt back to primarks and they gave me a full cash refund even though i lost my receipt? They do refunds, its 28 days policy and they only have the people at customer service trained to do refunds. guess you need your mate to give you the receipt as proof of payment and demand an exchange!!!

Reply:I think policies vary from shop to shop. It probably says on the back of the receipt that they don%26#039;t exchange goods without a receipt - which is great if you don%26#039;t have the receipt, like yourself, because then you%26#039;re not aware of this policy! Hope that makes sense!





However, maybe you should ask to see the manager, explain they were a present, that you haven%26#039;t worn them outside and that you feel you are entitled to an exchange. It%26#039;s worth a try.
Reply:thats very strange - coz if you have the tag on it proves you bought it from there! most stores exchange if you dont have a receipt as long as the shoes are not worn and still tagged

But I don%26#039;t think Primark do any refunds because it is super cheap. Some shops do not have refunds policy.
Reply:no they have to change them...you should have returned them within 28 days but an exchange is fair....they just be bothered....go in there and ask for a manager and threaten them with trading standards, lets us know how you get on
Reply:Think about it from their point of view, you could have just picked up a pair of their shoes and asked to exchange them. So because you have no proof of purchase there is no way that they no whether you stole them.
Reply:if they were the only thing you bought ou had a bank statement then that would be good proof as I assume no other shop sells the same shoes. Just depends how friendly and jobsworthy the person is I guess...

Reply:would have thought they would exchange/credit note. thats the usually the norm if in saleable condition and no reciept. Ask for H/O address and write/phone them
Reply:Unfortunately Primark are susceptible to people stealing - it%26#039;s a cheap shop, so people thieve. I worked there for a long time, and I came across an old coat - it was one that we sold, but this was clearly an old, well worn one. Someone had %26#039;exchanged%26#039; their coat for a new, clean one. They have to be strict with their policies - which unfortunately means that without the receipt, you can%26#039;t get anything, not even a straight exchange. It%26#039;s frustrating, but it%26#039;s a massive business - they don%26#039;t get that way by bending their rules. Plus, if they get an item that has a Primark label on it, but was bought more than 3 months previously, chances are the range will have finished and no one else will buy it because it%26#039;s either %26#039;out of fashion%26#039; or simply overlooked, therefore, they need the receipt to check the dates. Most stores have a policy of 28 day guarantee - Primark have longer, but you have to be able to prove it.

But only with a receipt, as without that they could have been stolen.





They are completely within their rights to refuse you an exchange

Reply:Most of us rely every time on teh goodwill of the shop to exchange items: they usually will exchange their items if they know they are theirs and they can re-sell the returned item.





Did she have the opportunity to fully try out the shoes before she paid the money - that is key- if she had no opportunity to really try them out they are in the wrong. If you had a chance to try them and didn%26#039;t take it there is no legal basis really for the exchange, nor if you did not return it in reasonable time.


Try again if you can and try to get that goodwill... do try to get the receipt as it wshows something...





Incidentally a receipt is not a necessary condition for a return of a mis-sold item in England or Wales. But it is v. difficult to prove you returned the item in a reasonable time without it!


Signs saying no receipt no return is a missrepresentation of the law which made my form tutor seethe,...

Reply:a lot of places will exchange without a receipt but they are entitled to insist on one before they do. as primark will not i suggest that you take your business elsewhere. tesco are pretty cheap and they will take anything back without a receipt, i know this because i am a bugger for throwing receipts away .
Reply:Sorry flicky23 but you do have to have a receipt for exchanges, the only time you can exchange without a receipt is when your purchase is faulty, but it has to be a manufacturing fault like seams coming undone or holes in the fabric.
Reply:they do refunds with receipt but you have to go to the top floor you never knew was there to get it.... they dont actually exchange but you do need the receipt - if your friend wont give you receipt ask her to take them back
